Don't send spam or break email laws

You own your content, we just help you send it

Cancel anytime, export your data first

We can update these terms with notice

1. Agreement to Terms

Understanding what you're agreeing to

By creating an account or using Gclap, you agree to follow these Terms of Service. This is a legal agreement between you and Gclap.

If you don't agree with any part of these terms, please don't use our service. We want everyone who uses Gclap to understand and accept these rules.

What this means: Using Gclap means you accept these terms. It's like signing a contract, but we've made it easy to read and understand.

2. Your Account

Requirements and responsibilities

Who Can Use Gclap

Age Requirement

You must be at least 13 years old to create an account. If you're under 18, you should have permission from a parent or guardian.

Business Accounts

If you're creating an account for a company or organization, you must have the authority to agree to these terms on their behalf.

Accurate Information

You must provide truthful and accurate information when signing up. Keep your contact details up to date.

Account Security

You are responsible for keeping your account safe. Here's what you need to do:

Use a Strong Password

Create a unique password that's hard to guess. Don't use the same password you use for other websites.

Enable Two-Factor Authentication

We strongly recommend turning on two-factor authentication (2FA) for extra security.

Report Suspicious Activity

If you think someone else is using your account, contact us immediately. You're responsible for all activity on your account.

One Account Per Person

Each person should have only one account. Creating multiple accounts to avoid our limits or restrictions is not allowed. If you need multiple accounts for different businesses, contact us first.

3. Acceptable Use Policy

What you can and cannot do

Gclap is a tool for sending legitimate emails. When using our service, you agree NOT to do any of the following:

No Spam

Don't send unsolicited bulk emails (spam). Only email people who have given you permission to contact them.

No Purchased Lists

Don't send emails to lists you bought, rented, or harvested from websites. Build your own list of people who want to hear from you.

No Illegal Content

Don't send content that's illegal, harmful, threatening, abusive, harassing, defamatory, or offensive.

No Phishing or Malware

Don't use Gclap to distribute viruses, malware, or phishing attempts. Don't try to steal people's information.

No Impersonation

Don't pretend to be someone else or misrepresent who you are. Always use accurate sender information.

No Unauthorized Access

Don't try to access other users' accounts, data, or any part of our system that you're not authorized to use.

No System Abuse

Don't overload our servers, interfere with our service, or try to bypass any limits or security measures.

Important: Violating these rules can result in immediate account suspension or termination. We take abuse seriously to protect all our users.

4. Email Compliance

Following email laws worldwide

You are responsible for making sure your emails follow all laws in your country and the countries where your recipients live. This includes laws like:

CAN-SPAM (USA)

United States anti-spam law

GDPR (Europe)

European data protection rules

CASL (Canada)

Canadian anti-spam legislation

Other Laws

Laws in other countries worldwide

What You Must Do

Get Permission First

Only send marketing emails to people who have given you clear permission (consent) to contact them.

Include Unsubscribe Links

Every marketing email must have a clear, working unsubscribe link that's easy to find and use.

Honor Unsubscribe Requests

When someone unsubscribes, stop emailing them immediately (within 10 business days maximum).

Include Your Address

Marketing emails must include your valid physical mailing address.

Use Accurate Information

Your "From" name, email address, and subject lines must be truthful and not misleading.

Keep Records

Keep proof of how people gave you permission to email them. You may need this if there's a complaint.

Note: Gclap provides tools to help you comply with these laws (like unsubscribe links), but you are responsible for using them correctly and following all applicable laws.

5. Your Content & Data

Who owns what

You Own Your Content

All the content you create and upload to Gclap belongs to you. This includes:

Store Your Data

We store your content on our secure servers to provide the service.

Analyze for Service Improvement

We may analyze aggregated, anonymized data to improve our service (we never read your individual emails for marketing).

Important: We don't claim ownership of your content. We don't sell your data to third parties. We only use your content to provide the service you signed up for.

Your Responsibilities

You are responsible for:

Making sure you have the right to use and send all content you upload
Not violating anyone's copyright, trademark, or other rights
Backing up your own data (we recommend regular exports)
Any legal issues that arise from your content

6. Our Service

What we provide and what to expect

Service Availability

We work hard to keep Gclap running smoothly 24/7. However, we can't guarantee 100% uptime. Here's what you should know:

Best Effort Uptime

We strive for high availability but may experience occasional downtime for maintenance or unexpected issues.

Scheduled Maintenance

We'll try to give advance notice for planned maintenance, usually during low-traffic hours.

Emergency Fixes

Sometimes we need to fix urgent issues without advance notice to protect the service and user data.

Service Changes

We're constantly improving Gclap. This means:

We may add new features or change existing ones
We may remove features that aren't working well (we'll notify you first)
We may update our interface and design
We'll communicate major changes through email or in-app notifications

Usage Limits

Each plan has specific limits (like number of emails per month). These limits:

Are clearly shown on our pricing page
Help us keep the service fast and reliable for everyone
Can be increased by upgrading your plan
May be adjusted with reasonable notice

7. Payment & Billing

How pricing and payments work

Free and Paid Plans

Gclap offers both free and paid plans:

Free Tier

Our free plan lets you try Gclap with limited features. No credit card required to start.

Paid Plans

Upgrade anytime to get more features, higher limits, and priority support.

How Billing Works

Billing Cycle

Payments are billed in advance, either monthly or yearly depending on your chosen plan.

Automatic Renewal

Your subscription automatically renews at the end of each billing period unless you cancel.

Payment Methods

We accept major credit cards and other payment methods through our secure payment processor (Stripe).

Failed Payments

If your payment fails, we'll notify you and try again. If payment continues to fail, your account may be suspended.

Taxes

Prices don't include taxes. Applicable taxes (like VAT or sales tax) will be added based on your location.

Price Changes

We may change our prices from time to time. When we do:

We'll give you at least 30 days notice before the change affects you
Your current billing period won't be affected
The new price will apply when your subscription renews
You can cancel before the renewal if you don't agree with the new price

Upgrading and Downgrading

Upgrading

You can upgrade your plan anytime. You'll be charged a prorated amount for the remainder of your billing period.

Downgrading

You can downgrade your plan anytime. The change will take effect at the end of your current billing period.

8. Cancellation & Refunds

How to cancel and what happens to your data

Canceling Your Account

You can cancel your Gclap account anytime from your account settings. No questions asked, no hassle.

Access Until End of Period

You'll keep full access to your account until the end of your current billing period.

No More Charges

We won't charge you again after you cancel. Your subscription simply won't renew.

Export Your Data

Before canceling, make sure to export any data you want to keep (contacts, templates, reports).

Data Deletion

After 30 days from the end of your billing period, we'll permanently delete your data. This cannot be undone.

Refund Policy

Our refund policy is straightforward:

Generally Non-Refundable

Subscription fees are generally non-refundable. When you pay for a month or year, that payment covers that period.

Exceptions

We may offer refunds in special cases (like billing errors or if we can't provide the service). Contact us to discuss.

Prorated Credits

If we terminate your account for our own reasons (not due to violations), we'll provide a prorated refund for unused time.

Tip: Not sure if Gclap is right for you? Start with our free plan to test everything before committing to a paid subscription.

9. Account Termination

When we might suspend or close accounts

When We May Terminate

We may suspend or terminate your account if:

You Violate These Terms

Especially for serious violations like sending spam, phishing, or illegal content.

You Break Email Laws

Violating CAN-SPAM, GDPR, CASL, or other email regulations.

Your Account Causes Problems

If your activity harms our service, other users, or our reputation.

Payment Issues

If your payment fails repeatedly and you don't update your payment method.

Legal Requirements

If we're required to do so by law or court order.

How Termination Works

We Usually Warn You First

For most violations, we'll send you a warning and give you a chance to fix the problem.

Immediate Termination

For severe violations (like spam or illegal activity), we may terminate immediately without warning to protect our service and users.

Appeal Process

If you believe your account was terminated by mistake, you can contact us to appeal the decision.

Important: If your account is terminated for violations, you may not be eligible for a refund, and we may keep your data for legal or security reasons.

To the maximum extent allowed by law:

Not Liable For: We're not responsible for indirect damages, lost profits, lost data, or other consequential damages that might result from using or not being able to use Gclap.

Your Responsibilities

You agree to:

Indemnify (protect) us from claims arising from your use of Gclap
Cover legal costs if your actions cause us legal problems
Take responsibility for your content and how you use the service

In Plain English: We work hard to provide a great service, but we can't be held responsible for everything that might go wrong. You're responsible for how you use Gclap and what you send through it.

13. Disputes & Governing Law

How we handle disagreements

Let's Talk First

If you have a problem or disagreement with us, please contact us first. Most issues can be resolved through friendly communication. We're here to help!

Governing Law

These terms are governed by the laws of the jurisdiction where Gclap is registered, without regard to conflict of law principles.

This means that if there's a legal dispute, it will be handled according to those laws and in the courts of that jurisdiction.

For Global Users

We serve users worldwide. While these terms are governed by a specific jurisdiction, we respect the consumer protection laws of your country. If your local laws provide you with stronger protections, those may still apply.

14. Changes to Terms

How we update these terms

We May Update These Terms

As Gclap grows and changes, we may need to update these terms. When we do:

We'll change the "Last Updated" date at the top of this page.

Give You Time

For major changes, we'll give you at least 30 days notice before they take effect.

Your Choice

If you don't agree with the changes, you can cancel your account before they take effect.

Continuing to Use Gclap

By continuing to use Gclap after the changes take effect, you're agreeing to the new terms. If you don't agree, please stop using the service and cancel your account.

Tip: We recommend checking this page occasionally to stay informed about any changes to our terms.

Entire Agreement

These Terms of Service, along with our Privacy Policy and Cookie Policy, make up the complete agreement between you and Gclap. They replace any previous agreements or understandings.

If any part of these terms is found to be invalid or unenforceable, the rest of the terms will still apply. The invalid part will be changed to the minimum extent necessary to make it valid.

If we don't enforce a part of these terms right away, it doesn't mean we're giving up that right. We can still enforce it later.

Assignment

You can't transfer your rights or obligations under these terms to someone else without our permission. We can transfer our rights and obligations to another company (for example, if we're acquired).

Force Majeure

We're not responsible for delays or failures caused by things beyond our reasonable control, like natural disasters, wars, pandemics, internet outages, or government actions.
